Cancellations and Refunds

You have a statutory right to cancel your order and receive a full refund within 14 days of placing the order. However, if you purchase a product where we need to start the work necessary to fulfil your order within this 14 day period, you have waived your right to a full refund.

MTS Terms of Sale and Cancellation and Refund Policy

These Terms of Sale and any documents referred to herein, set out the sales terms and conditions on which you are permitted to use our websites, www.mobiletesting.uk.com and www.mts-school.com (our websites). The Terms of Sale also show you what our cancellation and refund policies are for the goods and services we sell.

Please read these Terms of Sale carefully. We recommend that you print off a copy of these Terms of Sale for your records, as well as any future versions of them, as we may update them from time to time.

If for any reason whatsoever you do not agree to these Terms of Sale or do not wish to be bound by them, you must not use our services.

1. Our details

1.1 Mobile Testing Solutions Ltd (MTS) (we, our and us) operates the websites.

1.2 MTS is a limited liability company incorporated in England and Wales (company number 8706098).

2. Definitions

2.1 “Buyer” means the individual or organisation who buys or agrees to buy the Services from the Supplier, (you, your)

2.2 “Consumer” shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
2.3 “Contract” means the contract between the Supplier and the Buyer for the provision of Services incorporating these Terms and Conditions;
2.4 “Services” means the services that the Buyer agrees to buy from the Supplier;
2.5 “Supplier” means MTS (we, our and us)

2.6 “Terms and Conditions” means the terms and conditions for the provision of Services set out in this agreement and any special terms and conditions agreed in writing by the Supplier
2.7 “Website” means any website owned by MTS, including www.mobiletesting.uk.com and www.mts-school.com.

3. Conditions

3.1 Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.

3.2 These Terms and Conditions shall apply to all contracts for the provision of Services by the Supplier to the Buyer and shall prevail over any other documentation or communication from the Buyer.

3.3 Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Supplier.

3.4 Any complaints should be addressed to the Supplier’s address stated in clause 1.

4. Ordering

4.1 All orders for Services shall be deemed to be an offer by the Buyer to purchase Services pursuant to these Terms and Conditions and are subject to acceptance by the Supplier. The Supplier may choose not to accept an order for any reason.
4.2 When making an order through the websites, the technical steps the Buyer needs to take to complete the order process are described in the order processing section of the websites.

4.3 Ordering an IELTS test with the Supplier requires the Buyer to make an online or paper-based registration at the British Council’s Online Registration System, https://ielts.britishcouncil.org/mtsuk.

5. Price and payment

5.1 The price of the Services shall be that stipulated on the websites or email or other written document.
5.2 The total purchase price will be displayed in the Buyer’s shopping cart (or proposal) prior to confirming the order.
5.3 After the order is received the Supplier shall confirm by email the details, description and price for the Services together with information on the right to cancel if the Buyer is a Consumer.
5.4 Payment of the price must be made online at the time of order, unless otherwise agreed. Payment must be made without deduction or set-off.
5.5 Where applicable, if any payment is not paid on time or any payment is rejected or refused, the amount owing will be treated as overdue and the Supplier will be entitled immediately to cease or suspend the provision of the relevant Service until payment has been received.
5.6 Where applicable, the Supplier shall be entitled to charge interest on overdue invoices from the date when payment becomes due from day to day until the date of payment at a rate of 8% per annum above the base rate of the Bank of England from time to time in force.

6. Rights of Supplier

6.1 The Supplier reserves the right to periodically update prices on the websites, which cannot be guaranteed for any period of time. The Supplier shall make every effort to ensure prices are correct at the point at which the Buyer places an order.

6.2 The Supplier reserves the right to withdraw the Services from the websites at any time.
6.3 The Supplier shall not be liable to anyone for withdrawing the Services from the website or for refusing to process an order.

7. Age of consent

7.1 Where the Services may only be purchased by persons of a certain age the Buyer will be asked when placing an order to declare that they are of the appropriate legal age to purchase the Services.

7.2 If the Supplier discovers that the Buyer is not legally entitled to order certain Services, the Supplier shall be entitled to cancel the order immediately, without notice.

8. Cancellations and refunds

8.1 You have a statutory right to cancel your order and receive a full refund within 14 days of placing the order. However, if you purchase a product where we need to start the work necessary to fulfil your order within this 14 day period, you have waived your right to a full refund.

8.2 Specific cancellation and refund details with regards to the different products we sell are given below.

8.2.1 IELTS Tests

If you purchased a test that takes place in more than two weeks’ time, you have a 14 day period from the date of payment within which you can cancel your test and receive a full refund, or transfer the test to a new date.

If you purchased a test that takes place in less than two weeks’ time, you can request a refund/transfer but it will be subject to a £45 administration fee.

No refund/transfer can be offered if it has been more than 14 days since you paid for your test, or if you request to cancel/transfer less than 24 hours before your test.

If you are unable to attend your test because of exceptional circumstances, you can apply for a refund or test date transfer after the test. Only serious illness or injury, hospital admission, death of a close family member, or being the victim of a crime or traffic accident, will be considered. You will need to ask an appropriate medical or police professional to sign a request for refund or a test date transfer form. You will also need a medical certificate or police report. These must be sent to us no later than five working days after the test date.

8.2.2 Cambridge Tests

This applies to Cambridge Assessment Admissions Tests and Cambridge Assessment English exams.

If you have purchased a Cambridge test from Mobile Testing Solutions Ltd that takes place in more than two weeks’ time, you have a 14 day period from the date of payment within which you can cancel your test and receive a full refund.

If you have purchased a test that takes place in less than two weeks time, you can request a refund but it will be subject to a £45 administration fee. No refund can be offered if it has been more than 14 days since you paid for the test, or if you request to cancel less than 24 hours before your test.

The only exception is where you were unable to take part in the test because of a serious incident. Documentary evidence such as a medical or police report must be provided no later than five working days after the test date and a full refund will be issued. Eligible serious incidents include: serious illness or injury, hospital admission, death of a close family member, being the victim of a crime or traffic accident.

8.2.3 Online IELTS Prep Classes

If you have purchased an online course or class from Mobile Testing Solutions Ltd that starts in more than two weeks time, you have a 14 day period from the date of payment within which you can change your mind and receive a full refund.

If you have purchased an online course/class that starts in less than two weeks time, you can request a refund but it will be subject to a 20% administration fee.

No refund can be offered if it has been more than 14 days since you paid for the online course/class, or if you request to cancel less than 24 hours before it starts.

We offer a full refund if you were unable to take part in the course/class because of a serious incident. Documentary evidence such as a medical or police report must be provided no later than five working days after the course/class start date, and a full refund will be issued. Eligible serious incidents include: serious illness or injury, hospital admission, death of a close family member, being the victim of a crime or traffic accident.

We offer a full refund if you were not satisfied with the online course/class. In order to claim your refund, write to us by email to examsuk@mobiletesting.uk.com stating why you were not satisfied with the course/class. Any reasonable claim will be refunded.

8.2.4 One-to-one tuition sessions

Once you have purchased a one-to-one tuition package, you have 14 days within which you can cancel the package and receive a full refund. No refund can be offered if it has been more than 14 days since you paid for the one-to-one package. Once you have scheduled a one-to-one session with your tutor, no refund can be offered if you cancel the package less than 24 hours before the start of the session.

You can re-schedule a one-to-one session with your tutor provided that you give them 24 hours notice. If you cancel a session less than 24 hours before it starts you will not be able to re-schedule the session and no refund can be offered.

We can re-schedule or refund a one-to-one session if you were unable to take part because of a serious incident. Documentary evidence such as a medical or police report must be provided no later than five working days after the one-to-one session date, and a full refund will be issued. Eligible serious incidents include: serious illness or injury, hospital admission, death of a close family member, being the victim of a crime or traffic accident.

9. Limitation of liability

9.1 Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Supplier the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Services and the Supplier shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

9.2 Nothing in these Terms and Conditions shall exclude or limit the liability of the Supplier for death or personal injury resulting from the negligence of the Supplier or that of the Supplier’s agents or employees.

10. Waiver

No waiver by the Supplier (whether express or implied) in enforcing any of its rights under this agreement shall prejudice its rights to do so in the future.

11. Force Majeure

The Supplier shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire or failure of any communications, telecommunications or computer system, and the Supplier shall be entitled to a reasonable extension of its obligations.

12. Severance

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

13. Changes of Terms of Sale

 13.1 The Supplier shall be entitled to alter these Terms of Sale at any time but this right shall not affect the existing Terms of Sale accepted by the Buyer upon making a purchase.

13.2 Any renewal of the Services will be subject to the Supplier’s then current Terms of sale.
